This website is operated by Papillon Interior Designs. Papillon Interior Designs is a business in the Interior Decorating industry that provides interior design and decorating solutions. The website enables you to shop online for an extensive range of services which may include consulting services, 3D Designs (Services).

Throughout the site, the terms “we”, “us” and “our” refer to Papillon Interior Designs. Papillon Interior Designs offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

 

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

2 – GENERAL CONDITIONS

2.1 

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

 

3 -  CONTRACT

3.1 

These Terms and Conditions of Sale apply to Customers (“You”) requesting quotations, placing orders, or submitting tenders (“Orders”) to PAPILLON INTERIOR DESIGNS (“Us”, “We”, “Our”).

Our acceptance of Your Order brings into existence a legally binding contract between You and PAPILLON INTERIOR DESIGNS.

 

For design fees referred to as ‘3D Designs and mood boards’ there is 100% payment upfront prior to any design work commencing. Thereafter for implementation of services or goods there is a 70% value of your Order payable upon your acceptance of the quotation, the remainder is due upon completion and no later than 7 days.

 

 4 – MODIFICATIONS TO THE SERVICE AND PRICES

4.1 

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

 

 

5 - TERMS OF PAYMENT

5.1 

• For design fees referred to as ‘3D Designs and mood boards’ there is 100% payment upfront prior to any design work commencing.

• 70% of the implementation quotation for your Order is payable upon your acceptance of the quotation after design work completion stage. No works will commence on Your Order until the deposit reflects in Our account.

• The full outstanding balance shall become due and payable upon completion of work and no later than 7 days.

• Any dispute in respect of the goods or services or claim against Us shall not constitute grounds upon which to withhold payment. Any complaints, claims, or disputes shall be resolved in accordance with the appropriate channels.

• Ownership of the goods shall not transfer to You until We have received payment in full of the all amounts owing to Papillon Interior Designs by You without set-off, counterclaim, or other deduction save as required by law.

• Delinquent payments on any owing amount shall bear an interest equal to the prevailing prime rate of Our bank from time to time, plus 1.5% on the amount due and shall be calculated from the due date until payments are received by Us.

 

6 - INSPECTION

6.1 

• Inspection of the goods must take place upon delivery and any damage must be noted on the delivery note presented to You by the delivery contractors for signature.

• Notification of any damages or shortages upon delivery must be submitted to Us within 24 hours of delivery.

7 - WARRANTIES

7.1 

• To the extent merchandise (furniture, fabrics, or other materials, etc.) are furnished to the Owner, such merchandise will be covered exclusively by the manufacturer’s warranty. There are no warranties from the Designer beyond those provided by the manufacturer. All other warranties, whether expressed or implied, including the warranty of merchantability and warranty of fitness for a particular purpose are specifically disclaimed. The Designer does not warrant or guarantee any merchandise against inherent characteristics such as wearing, fading, or normal variations in size or color. No warranty or guarantee of performance, express, implied, or otherwise, is intended in connection with Designer’s services or Designer’s consultants’ services.

8 - CANCELLATIONS

8.1 

• Once an order has been placed and deposit paid by the Owner, it shall be non-cancellable, not returnable and non-refundable. If any item is cancelled by the Owner, the Owner will pay any expenses incurred by the Designer including but not limited to shipping and/or re-stocking fees.

9 - SUSPENSION AND TERMINATION

9.1 

• Either party may terminate this agreement upon 7 days written notice. In the event of suspension or termination not the fault of Designer, Designer shall be compensated for all services performed prior to the suspension of termination date.

• Failure of Owner to pay Designer in accordance with this contract shall be considered substantial non-performance and cause for termination. In the event that the termination is not the fault of Designer, Designer shall be compensated for services performed prior to termination. Designer reserves the right to retain possession of all Work Product until full payment for services performed has been received. Designer shall not be held liable for any damages as a result of such withholding of Work Product.

 

10 - PHOTOGRAPHY RIGHTS

10.1 

• The Designer will be permitted to make photographs or other reproductions of the work, or any portion thereof, and to thereafter publicly display the same through news media or otherwise. The photographs will be taken at a mutually agreed upon time that is convenient for both the Designer and Owner. The Owner will give this permission with the understanding that the Owner’s name and/or address will not be used without the Owner’s specific permission.
